Ohio was one of three states that had warned the Democratic Party that Mr. Biden could be left off the ballot because the Democratic National Convention would take place after certification deadlines for presidential nominees. Election officials in Washington State also signaled that their state would accept a provisional certification of Mr. Biden’s nomination. Charles Lutvak, a spokesman for the Biden campaign, said that Mr. Biden would be on the ballot in all 50 states. Republicans in Ohio have said that passing the ban on foreign donations is the price that Democrats will have to pay to ensure that Mr. Biden is on the ballot in the state. “If Ohio bars Biden from the ballot, the Supreme Court should order him back on the ballot just like it did with Trump in Colorado,” Ms. Torres-Spelliscy said.

A year and a half after police and intelligence officers in Germany uncovered a plot to overthrow the country’s government and replace its chancellor, the first of three trials in the sprawling case is set to begin on Monday in Stuttgart. As of Monday, March 4, 2024, Section 3 of the 14th Amendment of the Constitution is essentially a dead letter, at least as it applies to candidates for federal office. In the aftermath of the oral argument last month, legal observers knew with near-certainty that the Supreme Court was unlikely to apply Section 3 to Trump. None of the justices seemed willing to uphold the Colorado court’s ruling, and only Justice Sonia Sotomayor gave any meaningful indication that she might dissent. Or the court could have held that Trump, as president, was not an “officer of the United States” within the meaning of the section. It’s worth noting that, by not taking this path, the court did not exonerate Trump from participating in an insurrection.

WASHINGTON (AP) — The Supreme Court on Thursday heard two hours of historic arguments in a Colorado case to remove former President Donald Trump from the ballot. Murray gave well-rehearsed arguments that won the day in the Colorado Supreme Court, whose 4-3 ruling that Trump was ineligible got the case to Washington. Salmon Chase, who was then the chief justice of the Supreme Court, heard the case while acting as an appellate judge. Going into the case, the prevailing view of legal experts was the Supreme Court would keep Trump on the ballot. Would it mean a reelected President Trump suddenly becomes ineligible.

The Supreme Court will hear arguments on Thursday about whether Colorado may keep Donald Trump off the presidential ballot because of the storming of the Capitol on Jan. 6, 2021. The justices should seek a ruling that is originalist, modest and respectful of America’s democratic federalism. In particular, they should focus on two phrases: “the first insurrection of the 1860s” and “the fifty-state solution.”The first phrase explains why Mr. Trump’s conduct squarely falls under Section 3 of the 14th Amendment, which bars from any “office, civil or military, under the United States” any important public servant who, after swearing an oath to the Constitution, engages in an “insurrection” or gives insurrectionists “aid or comfort.”The second phrase highlights the Constitution’s well-established structure for presidential elections, blending democracy with federalism. A 50-state solution allows each state to use its own distinct procedures and protocols for applying Section 3.

His lawyers, and some of the dissenting justices from the divided Colorado Supreme Court, contend there were fatal flaws in the procedure and that his due-process rights were trampled. CNN —A former conservative federal appellate judge is urging the Supreme Court to keep Donald Trump off the ballot, arguing the ex-president’s effort to cling to power after his 2020 election loss was “broader” than South Carolina’s secession from the US that triggered the Civil War. Trump tried to prevent the newly-elected President Biden from governing anywhere in the United States. “Trump incited, and therefore engaged in, an armed insurrection against the Constitution’s express and foundational mandates that require the peaceful transfer of executive power to a newly-elected President,” the brief said. The US Supreme Court agreed earlier this month to review the unprecedented decision from the Colorado Supreme Court that removed him from that state’s ballot. In a 4-3 ruling issued last month, the state court said Trump is constitutionally ineligible to run in 2024 because the 14th Amendment’s ban on insurrectionists holding office covers his conduct on January 6, 2021.
